At Spark Enterprises BV (hereinafter: “we”, “us” or “our organization”), we value your privacy. We handle your personal data with care and transparency and comply with the General Data Protection Regulation (GDPR).
In this privacy statement, we explain which data we collect via our website www.sparksessions.nl, for what purposes we use it, on which legal basis we do so, how long we retain your data, and what rights you have.
1. Who is responsible for processing your data?

2. Personal data
We process your data only for legitimate and explicit purposes:
– Spark Enterprises processes personal data for entering into and performing agreements with its customers. In this context, we process, among other things, your name, contact details, and information about your body composition, such as weight and muscle mass. This data is necessary to provide the agreed services. For maintaining contact about appointments or changes
– Spark Enterprises also processes personal data to keep in touch with you about scheduled appointments or any changes. This generally includes your name, phone number, and email address.
– To monitor clients’ progress and training results, Spark Enterprises processes data that provides insight into your training activities and physical development.
– For the administrative handling of our services, including sending invoices and processing payments, Spark Enterprises processes personal data such as name, address details, and payment information.
– If you have subscribed, Spark Enterprises uses your name and email address to send newsletters or other forms of marketing communication. You can unsubscribe at any time via the opt-out provided in the communication.
– Spark Enterprises also processes data about the use of its services and website to improve our services and website functionality. This may include technical data about the device and browser usage, and information about your interaction with the website.
– Spark Enterprises collects and processes applicant data through personal contacts, by post, by email, and/or phone calls. We collect, among other things, the applicant’s name, gender, contact details, motivation letters, information about education level, and employment history. This data is relevant for the application process and will be deleted no later than 4 weeks after the procedure ends. If you give consent, Spark Enterprises may store your personal data longer in its records so we can contact you again in the future.
– To protect the safety of customers, employees, property and to prevent theft, vandalism, and other incidents, Spark Enterprises uses CCTV. CCTV is used only in the general, customer-accessible areas of the studio, such as the training area, entrance, and possibly the immediate outdoor area. There is no CCTV in changing rooms or sanitary facilities.
– Spark Enterprises also processes employees’ personal data in the context of the employment contract and on the basis of legal grounds. For information about processing employees’ personal data, please refer to the staff handbook.
3. Recipients
We do not share your personal data with companies, organizations, and individuals outside Spark Enterprises, except in the following circumstances.
– Processing is necessary for the performance of a contract;
– You have given consent for the processing of your data;
– Processing is necessary to comply with a legal obligation, for example to meet applicable laws and regulations, legal procedures, or requests from government authorities.
– Processing is necessary for the pursuit of a legitimate interest, such as improving our services or marketing to existing customers. We provide personal data to our partners so they can process data for us, based on our instructions and in accordance with our privacy policy and other appropriate confidentiality and security measures. Our partners include, among others, our IT suppliers, website administrator, and CRM system provider. We always balance interests in these cases.
4. Transfer of personal data outside the EU
Spark Enterprises may transfer your personal data from the Netherlands to other countries. Countries within the European Economic Area (EEA) have a level of personal data protection equivalent to the Netherlands. Subject to the general requirements of privacy laws and regulations, we may transfer your personal data. We may do so, for example, for proper business operations.
Outside the EEA, we will only transfer your personal data if there is an adequate level of protection. Spark Enterprises uses European Commission–approved standard contractual clauses for this purpose.
5. How long do we keep your data?
We do not retain your personal data longer than strictly necessary for the purpose for which it was collected, unless we are legally required to keep your personal data longer. As a general rule, client files are archived for 2 years after closure and then destroyed. If, for example, you have provided your email address to receive newsletters, we will retain your email address specifically for that purpose.
6. Your rights
You have several legal rights with respect to us: access, rectification or completion, erasure, restriction of processing, portability of digital data, and the right to object. Below we explain these rights and how you can exercise them with us.
Right of access
At your request, we will inform you in writing whether we process personal data about you. You must identify yourself with a copy of your driver’s license or ID document. In our response, we explain which personal data we have processed or are still processing about you and provide you with a copy. We also explain the purposes for which the data has been or is being processed, with whom the data is shared, how long it is expected to be stored, and which other rights you can exercise.
Rectification or completion
If you have received access to the processing of your personal data, you can ask us to correct inaccuracies or complete incomplete data. We will explain our response. If we proceed to correct, you will receive an additional statement from us. Any recipients of your incorrect or incomplete data will also receive that statement.
Erasure of data
You can ask us to delete your personal data from our systems in one or more of the following cases:
– the personal data is no longer needed for the purposes for which we processed it;
– you withdraw your consent for (further) processing; and there is no other legal basis for processing;
– you lodge a reasoned objection, and there are no compelling reasons not to honor your objection;
– the personal data has been processed unlawfully by us;
– we must delete your personal data due to a legal obligation;
– we collected your data through mobile telephony or internet services.
Restriction of processing
If you have reported an inaccuracy or incompleteness in your personal data to us, you can ask us to restrict processing while we handle your request. You may also ask us to restrict the processing of your data if you believe we are processing your data unlawfully or no longer need it, or if you have objected to (further) processing. After receiving your restriction request, we will only process the data with your consent or for compelling reasons (such as legal proceedings).
Data portability
If you have provided personal data to us in a structured, commonly used digital format, and we have processed your data with your consent or in the performance of a contract with you, you have the right to request a copy of this data. In such cases, you can also ask us to transfer your data directly to another service provider.
Objection
You may object at any time to the processing of personal data relating to you. This applies in particular to profiles we have created based on your personal data. We will stop processing your data after receiving your objection, unless we can demonstrate compelling legitimate grounds that override your interests, rights, and freedoms.
If we process your personal data for direct marketing purposes, you may object at any time and we will stop the processing immediately.
7. Exercising your rights
If you want to exercise one or more of your rights listed above, you can contact us via the email address info@sparkenterprises.nl. We will decide on your request within 4 weeks, unless we inform you within that period that we need a little more time.
Are we processing your personal data based on your consent? Then you have the right to withdraw your consent. Any withdrawal does not affect processing carried out before the withdrawal.
8. Withdrawal of consent
If the processing of your data is based on consent, you have the right to withdraw that consent at any time. This does not affect the lawfulness of processing before the withdrawal.
9. Liability
Despite the care and attention given to managing this website, it is possible that the site contains incorrect information. Spark Enterprises cannot be held liable for technical or editorial errors on this website, nor for any consequential damages resulting from the use or temporary unavailability of this website or links to third-party websites.

11. Mandatory provision of data
In some cases, we are required to request certain personal data, for example to enter into a contract or comply with tax obligations. If you do not provide this data, we may not be able to enter into a contract or deliver a service.

We do not use automated decision-making or profiling that has legal effects on you or otherwise significantly affects you.
13. Security measures
We take appropriate technical and organizational measures to protect your personal data against loss, misuse, unauthorized access, or other unlawful forms of processing.

If we intend to use your personal data for a different purpose than the one for which it was collected, we will inform you.
